Intellectual Property, Rights and Licensing Management

Due to the innovative nature of the Technology and Telecommunications sector, companies generate intellectual Property ("IP"). Many companies do at some stage require a valuation of their IP, whether it be on acquisition or exit, or simply for accounting purposes under IFRS or US GAAP. We have experience of valuing a wide range of businesses across the sector.

We also advise and assist companies in structuring their operations so that IP is located in the territory or company where it remains the most tax efficient to do so.

Many businesses have licensing, franchising, supplier or distributor agreements. These are typically complex, and invariably over time there is an element of "revenue leakage" due to technical or administrative reasons. This does affect the bottom line - it is said that a telecom operator loses at least 5% of its revenues in this way. Our forensic team helps many organisations minimise their risk, protect their rights, and investigate areas of leakage, thereby saving businesses thousands or even millions of pounds.

We also act as an independent expert witness for organisations involved in intellectual property disputes. This usually requires an assessment of the quantum of damages flowing from the infringement of intellecutal property rights, such as patents, copyright, trademarks or design rights.
